Kokomo student charged with rape, sexual battery

KOKOMO, Ind. (WISH) — A 16-year-old boy has been charged with rape after he was accused of raping a classmate at school, according to court documents.

According to the probable cause affidavit, on May 7 at Taylor Community High School the principal was approached by the victim saying they had been touched inappropriately by another student.

The principal told the liaison officer that the student and Zachary Spencer were in a side room by the guidance officer. The court documents say that the two were left alone in the room when the rape happened. According to the victim, Spencer gave the victim a hug and then pulled down her pants and sexually assaulted the victim. The victim told Spencer to stop.

The court document said that Spencer told the victim not to tell anyone. When the victim walked back to the classroom the teacher could tell she was upset and asked. The victim asked the teacher to go to the office.  At that time she told the guidance counselor what happened.

Spencer was located and brought to the principal’s office where he was questioned and denied the rape. The liaison officer transported Spencer to the Robert J. Kinsey Youth Center for further questioning.

A rape kit test was administered and the suspect’s cellphone and clothes were confiscated.

Spencer faces rape, sexual battery and confinement charges. His case is in adult court.
