NOBLE COUNTY, Ind. (WANE) A Fort Wayne man was sentenced Thursday in Noble County to three years in prison for moving a body from a scene. As part of a plea agreement, Victor Manuel Gonzalez admitted he helped his brother move the body of Erin Justin to Bartley Lake in Noble County in 2011.

Meanwhile, the location of the murder trial for Gonzalez’s brother, Andres Gonzales Jr., has yet to be determined. Noble County Prosecutor Steven Clouse is asking the Indiana Court of Appeals to reconsider a judge’s decision to move the trial from Noble County to Allen County. A judge ruled in May that Andres Gonzalez should be tried in Allen County rather than Noble County, because that’s where the killing reportedly took place.

Police started investigating Andres Gonzalez in March of 2014 after police received a tip.

In March of 2014, an Indiana State Police Detective interviewed Colleen M. Gonzalez, who told police the Gonzalez brothers used Andres’ car to move Justin’s body to the lake.

Police met with Victor Gonzalez, who said he helped his brother by putting Justin’s body in the trunk of Andres’ car and driving to Port Mitchell Lake in Noble County where the two had fished before. He said his brother told him he had attacked Erin Justin and that he choked her.

Andres Gonzalez then told police he picked up Erin Justin on Bluffton Road during June of 2011 and took her to his garage where he attacked her. Andres told police at one point, Justin became unresponsive. He said the next day he called his brother to help him get rid of the woman’s body.

Andres and Victor were arrested in March of 2014. Clouse is waiting for a ruling from the Court of Appeals before proceeding any further with Andres’ trial.
