FWPD officer charged with rape

FORT WAYNE, Ind. (WANE)  A Fort Wayne Police Department Officer is now facing two additional rape charges, class B felonies, after initially being arrested and charged with sexual misconduct in September.

Mark Rogers, 45, is accused of coercing a drunken woman to have sex with him while she was in his custody during OWI patrol.

Rogers, a 19-year veteran of the FWPD, has been suspended without pay since his arrest on September 16. He was initially charged with sexual misconduct, a class C felony; official misconduct, a class D felony; and false informing, a class a misdemeanor. In a hearing on Monday, the state added two class B felony rape charges against him.

According to the Affidavit for Probable Cause, Rogers had sex with a woman he had detained while working OWI Enforcement Patrol. The woman told police she went along with the acts as “she feared for her physical safety and because she knew the defendant was a Fort Wayne Police Officer.”

According to the Affidavit, Rogers picked her up for driving while intoxicated over the labor day weekend and took her to the hospital as she was vomiting. She was diagnosed with alcohol intoxication and released back into Rogers’ custody. In Rogers’ report of the night, he had stated that the woman was left at the hospital. Security footage from the hospital however, does show Rogers escorting the woman out of the hospital in handcuffs.

The woman told police Rogers then put her in the back of the police car and stopped at several locations before taking her out of the car and removing her handcuffs. She told police he then walked her to a park bench and had sex with her. She then reported to police that she had been sexually assaulted by Rogers.

The complaint against Rogers originated in Allen County’s jurisdiction, the Allen County Sheriff’s Department is therefore handling the case.
